‘Costa Concordia’ victims file lawsuit
Victims of the ‘Costa Concordia’ cruise ship which capsized in January off the Italian coast have filed a new complaint against Carnival Corporation, the builder of the cruise ship, Carnival Corporation & PLC, Costa Cruise Lines Inc and Costa Crociere SPA.
All firms face Florida state law for Maritime Negligence, Gross Negligence, Negligence – Product Defect, Corporate Pattern and Practice of Failure to Warn, Intentional Infliction of Emotional Distress, Negligent Retention, Fraudulent Misrepresentation and Fraudulent Inducement, among other charges. Another claim against wrongful death on behalf of other parties is to be filed shortly.
Marc Jay Bern, co-attorney, Napoli Bern Ripka Shkolnik & Associates, LLP, said: “No one got off the Concordia unscathed. Even those who survived and avoided serious physical injuries will never be the same after the horror they lived through. These people trusted a well-known cruise industry brand and had every reason to believe they were in responsible and experienced hands but unfortunately that proved to be anything but the truth.”
The lawsuit claims that Carnival was aware of the defects of the ship’s hull design and power systems due to previous problems with the hull of Carnival’s Costa Europa in February 2010.
Victims are looking for at least US$2m in compensation per passenger and attorneys Napoli Bern Ripka Shkolnik & Associates, LLP, Proner & Proner and Codacons, plan to ask for US$590m in punitive damages.
