The new edition has been considerably enlarged to include the impact of the ISM code on the way evidence is collected following an incident.

The Mariner’s Role in Collecting Evidence has been re-written by Dr Phil Anderson to include the influences of the ISM code on accident and loss prevention. Under the Code ships are required to have a Safety Management System. The system has to be audited regularly and records how the ship and company manage and monitor their safety and environmental policies.

The book covers in details the evidence which needs to be collected in the event of cargo loss or damage, collision, fire, injury, pollution and commercial disputes. It is an essential guide which is indispensable after a major incident like a collision.

As well as the technical content of this book, there is a unique feature – it is published by an independent Institute detached from any particular bias. The advice provided in this book contains the thoughtful application of principles related to the ISM Code which has been the subject of extensive research by the author Phil Anderson.

The main element added to this revised edition concerns the effect of the ISM CODE, central to this Code is the Safety Management system. If this System is effective, loss, damage and personal injury should diminish. In the introductory section Phil Anderson points out that when there is an incident the facts will be considered and then examined to see if weaknesses in ship and company organisation contributed to the event. Lack of supporting evidence could significantly weaken the case for the ship owner.

Dr Phil Anderson is managing director of his own specialist ISM expert witness and consultancy firm, he spent 11 years serving on a variety of ships and 25 years working in P&I clubs – initially handling a wide range of claims and disputes before moving on to develop pioneering work in loss prevention and risk management.

Widely regarded as being amongst the world’s leading experts on the ISM Code, his Doctorate was awarded by the Middlesex University in recognition of extensive research he undertook into the Managing of Safety on board ships. The Nautical Institute book, Cracking the Code, includes details of his research findings. Dr. Anderson is a Member of the Expert Witness Institute and a Practising Associate of the Academy of Experts, most of his time is involved in providing expert advice to lawyers, insurers, the Courts and Arbitration tribunals around the world on the potential ISM implications in marine casualties and claims.
